All entries received before the drawing deadline(s) will be entered into the associated drawing and all subsequent drawings whether or not your ticket stub has been mailed to you. Your numbered ticket receipt(s) will be mailed to you after your check or credit card is processed. Although it may take four weeks before you receive your receipt(s), the raffle ticket(s) with matching numbers will be placed in the official drum for the drawings. ALL SALES ARE FINAL. NO REFUNDS. Only 250 tickets will be sold. Must be 18 years or older to enter. Void where prohibited. Raffle subject to rules and regulations.
Alternatives Pregnancy Center’s Jacuzzi Hot Tub for Life 2010 Raffle
Rules: Jacuzzi Hot Tub for Life 2010 Raffle benefiting Alternatives Pregnancy Center, of 2628 El Camino Ave., Ste. B-1 Sacramento, CA 95812. Alternatives Pregnancy Center of Sacramento, CA will conduct the Jacuzzi Hot Tub for Life 2010 Raffle (the ‘Raffle’) as described in these rules. By purchasing a Raffle Ticket, each participant acknowledges that such participant has read, understands and agrees to be bound by the terms hereof.
1. Grand Prize. The grand prize (Grand Prize’) is a Jacuzzi J-270 or J-280 with an approximate value of $9,195.00. Only one Grand Prize will be awarded subject to these rules. The Prize is provided to Alternatives Pregnancy Center of Sacramento, CA for purposes of this Raffle. Drawing to be held on September 24, 2010. The winner may exchange the prize for credit towards any Jacuzzi Hot Tub model they would like. If an exchange is done, the winner will be responsible for the wholesale difference between the J-280 or J-270 and whichever model they select. If selecting a model of lesser value, there will be no credit given.
2. Raffle Tickets. Raffle tickets (‘Raffle Ticket’) cost $50.00 per Raffle Ticket. Raffle Tickets may be purchased in person, online or by phone from an authorized representative of Alternatives Pregnancy Center of Sacramento, CA. Raffle tickets may be purchased with an authorized and approved Visa, Discover, Amex or MasterCard credit card transaction, with cash or by personal check made payable to Alternatives Pregnancy Center of Sacramento, CA. If a participant’s check is dishonored for payment by their bank for any reason, or, should the Visa, Discover, Amex or MasterCard banking institution decline the credit card charge for any reason, the participant’s Raffle Ticket(s) will be declared an invalid entry and deemed void. By purchasing Raffle Tickets, the participant understands and agrees that Alternatives Pregnancy Center of Sacramento, CA will not be responsible for any errors in credit card approval and/or bank check processing.
3. Eligibility Requirements. Participants must be 18 years or older. Employees and BOARD members of the Alternatives Pregnancy Center of Sacramento, CA are not eligible to participate in the Raffle.
4. Drawing. The Grand Prize winner will be determined by a random drawing on Friday, September 24, 2010, by m. Deadline to enter is Friday, September 24, 2010. The winner of the Prize drawing will be notified by Alternatives Pregnancy Center of Sacramento, CA as soon as possible following the drawing. The prize will be awarded as soon as the Eligibility Requirements for the Grand Prize as set forth herein, are met. Winner does not need to be present at the time of drawing to win.
5. Publicity By participating, where allowed by law, all participants and winners grant the Alternatives Pregnancy Center of Sacramento, CA the exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this, other raffles, contests and waive any claims to royalty, right, or remuneration for such use.
6. Release By participating in the Raffle, each participant and winner waives any and all claims of liability against Alternatives Pregnancy Center of Sacramento, CA, its employees and agents, the Raffle’s sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Raffle, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by the Alternatives Pregnancy Center of Sacramento, CA.
7. Taxes, Expenses and Disclaimer of Warranties. Any valuation of the Grand Prize will be based on available information provided to the Alternatives Pregnancy Center of Sacramento, CA, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes, tag, and title cost related to the prize and paying any expenses associated with the prize prior to taking possession of the prize. THE ALTERNATIVES PREGNANCY CENTER OF SACRAMENTO, CA SPECIFICALLY DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE REGARDING ANY OF THE PRIZES.
8. Use of Proceeds. All proceeds from the Raffle, less any reasonable expenses associated with executing the Raffle will be used strictly for purposes as determined by the Alternatives Pregnancy Center of Sacramento, CA operating under a Non-profit 501 (c)3 tax exempt status. The Alternatives Pregnancy Center of Sacramento, CA is a tax exempt organization and is qualified under Section 501(c)(3) of the Internal Revenue Code. Your purchase of a raffle ticket may be possibly deductible as a charitable contribution for income tax purposes but the acceptability of such charitable deductions should only be done following consultation of your tax advisor.
9. Conduct and Decisions. By participating in the Raffle, participants agree to be bound by the decisions of the Alternatives Pregnancy Center of Sacramento, CA personnel and representatives. Persons who violate any rule, attempt to, or otherwise gain unfair advantage in participating in the Raffle, or obtain winner status using fraudulent means will be disqualified. The Alternatives Pregnancy Center of Sacramento, CA will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Raffle and the Alternatives Pregnancy Center’s decisions concerning such disputes shall be final. If the conduct or outcome of the Raffle is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Alternatives Pregnancy Center of Sacramento, CA. The Alternatives Pregnancy Center of Sacramento, CA reserves the right to terminate the Raffle and refund all ticket purchases, or make such other decisions regarding the outcome as the Alternatives Pregnancy Center of Sacramento, CA deems appropriate. The decisions of the Alternatives Pregnancy Center of Sacramento, CA and its authorized representatives shall be final on any and all matters concerning the execution of the Raffle and the awarding of the prizes The Raffle shall be governed by the laws of the State of California and, where applicable, the United States of America.
